Swabi Tastes' Terms of Use and Privacy Policy for Restaurants

Identifying Parties: In this agreement, “you” refers to the consumer who engages with this software platform, known from here as the “Swabi Tastes” software platform. The marketplace owner will be known as “Swabi Mobile Inc.” Each restaurant in the marketplace will be known as one of the “restaurants.”
General Concepts: The software platform is comprehensive including a Point of Sale System, Smart Watch apps, Smartphone apps, table tablets, kiosk tablets, and websites. Swabi POS is the point of sale system. SwabiTastes.com is the consumer facing website and SwabiRestaurants.com is the admin website for restaurants. “Swabi Mini” is the Smart Watch app for the consumer. “Swabi Host” is the Smart Watch app for restaurant employees. “Swabi Table” is the table tablet app. “Swabi Hello” is the kiosk app. The entire software system delivers the best experience for consumers and businesses in the marketplace. You can view restaurant menus, order online, engage with social media from the table tablet and “Swabi Tastes” consumer app, sign in with the kiosk app, and get notifications through the smart watch app. Restaurants in the marketplace can administer their presence through the POS and SwabiRestaurants.com website as well as receive notifications on the Smart Watch.
About Swabi: Swabi Mobile Inc is a software platform provider. The corporation is based in the United State of America in the state of California. The headquarters is based in Temecula, CA.
Using Swabi: By using any of the applications within this software platform, you agree to all the terms in this agreement that apply to you as one of the “Identifying Parties.”
1. Consumer - Users are able to obtain information in the form of menu items, suggestions for ordering, and share with friends about favorite foods.
2. Marketplace Restaurant - Restaurants can provide savings to consumers through promotions and convenience of online services such as ordering and seating when at a restaurant.
3. Swabi Mobile - The software platform provides a comprehensive marketplace for consumers and marketplace restaurants to interact.
Alcoholic Beverages Policy: Alcoholic beverages are not allowed for delivered orders using the software platform. Please add on to the order any alcoholic beverages during pickup at the restaurant.
Payment and Credit Policy: Payment with credit card is consistent with the guidelines of Stripe Inc. All transactions in terms of security, privacy, and procedure follow the standards in the industry for credit card processing. Payment to marketplace restaurants are made following the schedule and process agreed between the restaurant and Swabi Mobile during sign up of services.
1. Consumer - Consumers may have charge amounts held temporarily until transactions are finalized. For whatever reasons, restaurants may refund the charge partially or in full.
2. Marketplace Restaurant - Payments are officially made into Swabi’s account to be distributed to individually held accounts by the marketplace restaurants.
3. Swabi Mobile - Swabi charges no additional fees for credit card processing and marketplace restaurants only pay essential fees to the payment processor.
Materials and License: All visual assets by each restaurant are owned and presented by the restaurant. Menu items produced by the restaurant have quality guaranteed by the restaurant and are not guaranteed by Swabi Mobile. Each marketplace restaurant owns its materials and licenses.
Conduct: Activity on Swabi Tastes is expected to be authentic and any misconduct or misrepresentation of other parties will be requested for investigation by law enforcement. Orders placed within the platform should be valid and from original consumers.
Communications and Text Messages: All communication via emails, text messages, and push notifications will only be transmitted if the consumer agrees and opts in to such messages.
1. Consumer - Communication to the consumer may be in the form of email, SMS, or Push notification. Agreeing to this agreement means the consumer has consented for such communication to be directed to them.
2. Marketplace Restaurant - Communication towards the marketplace restaurant can take the form of ordering on the Swabi Tastes platform, phone calls to the business, and electronica messages such as email.
3. Swabi Mobile - The software solution provides all interactions between consumers and marketplace restaurants and includes but not limited to consumers’ preferences for menu items and other information collected on the platform by consumers and marketplace restaurants.
Additional Terms For Mobile Applications: Use of any mobile app expects legitimate use that’s authentic and valid. Any suspicious or deemed unlawful use may exclude the consumer of further use of the platform.
1. Consumer - By installing or using any of the software platform’s applications, the consumer agrees to the terms in this document.
2. Marketplace Restaurant - By installing or using any of the software platform’s applications, the restaurant agrees to the terms in this document.
3. Swabi Mobile - Swabi Mobile Inc agrees to this document with any consumer or marketplace restaurant.
Disclaimere: All data collected by the platform is not guaranteed to be correct, valid, and persisted. The consumer and restaurant will explicitly opt in to all the terms in this agreement.
Limitations of Liability: Any liabilities caused as a result from these conditions mentioned in “Disclaimer” are not held responsibilities by Swabi Mobile Inc.
Third Party Links: If users go to any links of Third Parties, then these users must adhere to the conditions of those sites and any subsequent consequences of using those sites cannot cause Swabi Mobile to be held liable.
Privacy Policy: All data is not guaranteed to be accurate, persisted, or available in all cases. Swabi Mobile believes we have excellent quality assurance but we cannot place guarantees to handle all possible situations.
1. Consumer - Information of all end users whether from restaurants or consumers are secured and protected to safe guard your identity. However, your data will be used to provide an improved experience with the software platform and data is used to determine the best way to serve the community of the platform. Some scenarios where your data is processed is with friend sharing, factors driving future promotions, and inputs for analytics. Swabi Tastes will always prompt you to know when data associated with your identity is shared or processed.
2. Marketplace Restaurant - Restaurant data is accessible only by the individual restaurant itself. Restaurants do have access to personally identifiable information to better serve consumers.
3. Swabi Mobile - All data is secured but in cases mentioned above the data my be processed, interpreted, and disseminated as long as the consumer consents. Denying the consent of data processing by the consumer will mark the data as not processable.
Copyright Policy: Swabi Mobile returns all its copyrights as permitted by law while any restaurant in the marketplace may retain its individual copyrights when displaying its owned content within Swabi Tastes.
Termination and Violations of the Agreement: Termination may happen due to any violation or any reason deemed by Swabi Mobile.
Changes to the Agreement: Future updates to this agreement will supersede this current version.
Governing Law: All operations and activities within Swabi Tastes will be under the jurisdiction of the State of California within the United States of America.
Dispute Resolution: Arbitration within California will be the means of conflict resolution in case of disputes.
